Experience
Bankruptcy of a paper manufacturer and representation on the creditors' council
We represented one of the largest banks in Poland at all stages of the bankruptcy proceedings (including as a member of the creditors’ council) of a company in the paper production and distribution industry with fixed assets located throughout Poland. As a result of actions taken by the receiver in close cooperation with the members of the creditors’ council, the assets of the estate were duly secured and rebuilt, and the level of satisfaction of creditors turned out to be higher than expected.
Bankruptcy of a natural person and their application for debt relief
We represented one of the largest banks in Poland in bankruptcy proceedings against a natural person, resulting in the court rejecting the debtor’s application for the cancellation of their liabilities without establishing a repayment plan. This was achieved, among other things, thanks to our detection of asset transfers through which the debtor deliberately made himself insolvent in order to harm his creditors, including the bank.
Restructuring of a textile industry entity
We represented one of the largest banks in Poland in accelerated (restructuring) composition proceedings involving a textile company. Despite the bank’s claim being included in the list, we ensured that it was not covered by the arrangement and that its amount was not reduced in accordance with the provisions of the arrangement. An extract from the list of claims allowed for effective enforcement against the debtor and the recovery of the entire claim.
Restructuring of a construction company
We represented one of the largest banks in Poland in restructuring arrangement proceedings involving a construction company. The debtor did not recognise the bank’s claim, so we filed appeals, which effectively halted the proceedings until they were heard and ultimately led to the reversal of the judge-commissioner’s decision refusing the bank participation in the proceedings.
