Jarosław Jerszyński

Specialises in intellectual property law, new technologies, protection of information and data (including personal data) and labour law. Advises entrepreneurs in ongoing operational activities, ownership structures and commercial transactions, as well as in preparing and negotiating commercial contract – particularly IT implementation, licensing, distribution and investment agreements.
He has broad experience in the film sector, where he provides comprehensive legal support in audiovisual projects – from the development stage through production and financing to distribution. He cooperates with creators, investors, co-producers, distributors and institutions supporting the sector, such as the Polish Film Institute. He also advises on projects in e-commerce, media, music and publishing.
In the area of labour law, he supports companies in designing remuneration and working time systems (including in financial institutions), drafting regulations and resolving employement disputes.
Conducts training and advises on GDPR, cybersecurity and internal data protection procedures.
Together with Gracjan Pietras and Marcin Liszka, he co-created Bitcoin Desk (www.djp.pl/bitcoindesk).
Since 2020, he is annually recommended in The Legal 500 EMEA ranking in the TMT category (Technology, Media and Telecommunications).
Graduated in law at Adam Mickiewicz University in Poznań and the British Centre for English and European Law at the University of Warsaw. Fluent in English.
In free time, he devotes himself to manual work. Also passionate about figurine modelling, which combines manual precision with a love for detail. Also spends free time cycling.

Experience
Comprehensive Legal Support for a Film Producer
Since 2019, Jarosław Jerszyński has personally, and as the head of his law firm’s team, been working with one of the leading film producers in Poland, providing comprehensive legal support for the production of feature films, documentaries, and series. His advisory work covers the entire production process—from development and financing arrangements to the distribution and sale of rights to completed works. As part of this collaboration, Jarosław Jerszyński has participated in the execution of numerous film projects, with additional projects currently underway.
During the production preparation phase, Jarosław Jerszyński advises on the organization of project financing, including public funding, and on the drafting and negotiation of co-production, investment, and grant agreements, as well as other financial support for audiovisual production. Throughout pre-production and production, the firm’s team, under his direct supervision, handles the clearing and protection of copyrights necessary for the projects, in particular rights to scripts, book adaptations, music, and other works used in production, and prepares and negotiates agreements with creators.
Jarosław Jerszyński and his team also provide support during post-production, negotiating agreements for sound design, editing, special effects (CGI), and other post-production services, as well as licensing and distribution agreements.
Innovative Projects in Labor and Employment Law
Jarosław Jerszyński leads a team of lawyers specializing in labor and employment law, as well as disputes arising from employment relationships. His role encompasses both strategic advisory work and direct involvement in key cases, as well as oversight of the team’s activities.
One of the projects involved designing a comprehensive, innovative bonus programme for a financial institution, aimed primarily at retaining a key team during a change of ownership. Jarosław Jerszyński and his team were responsible for developing the programme’s innovative rules and overseeing its implementation. The correctness of the programme’s design was later confirmed by a court in a dispute with one of its participants.
Another significant project involved implementing whistleblower procedures for a private equity fund, including defining cooperation principles between group companies and developing and deploying systems for reporting irregularities. Jarosław Jerszyński also leads the team responsible for responding to whistleblower reports, conducting internal investigations, and examining potential breaches.
Projects in Information Protection
Jarosław Jerszyński leads a team of specialists focused on information protection, including personal data and confidential information. His team advises clients on ensuring that their operations comply with national and EU regulations on personal data protection, in particular the GDPR.
One of the projects involved the comprehensive development of an operational model and documentation on personal data protection for a non-public medical facility providing services in the field of mental health care. Under Jarosław Jerszyński’s guidance, the team prepared regulations, internal policies, as well as clauses and consents required for the processing of sensitive data, taking into account the specifics of medical practice and the professional duties of the staff.
Another significant project entailed analysing the cooperation model between a financial institution and a retail network, which enabled the design and implementation of a solution compliant with personal data protection laws. The advisory work included assessing the roles of the parties, data processing principles, and the scope of responsibilities, ensuring the business model could operate safely and legally.
Operational Regulations for Business Operators
Jarosław Jerszyński advises on the development of internal regulations and documents governing the operations of companies, assisting clients in establishing transparent and legally compliant operational rules. He leads a team of lawyers that prepares solutions tailored to the organizational structure of clients and the nature of their business activities.
One of the projects involved supporting companies within a State Treasury capital group in drafting regulations concerning the support of entrepreneurs, internal control, and compliance management. As part of the collaboration with the group companies, Jarosław Jerszyński’s team also developed whistleblower procedures and comprehensive compliance policies, adapted to the group’s structure and the requirements of public law.
Another project entailed preparing regulations for an e-commerce platform engaged in the distribution of games. This work included shaping the rules for providing electronic services, distributing digital content, and managing relations with platform users, in a manner consistent with the specifics of the digital market and consumer protection law.
