Specialises in litigation, insolvency and restructuring law and debt recovery from dishonest debtors. Represents entrepreneurs from various sectors in court disputes, in particular in proceedings concerning financial instruments and challenging fraudulent conveyances made to the detriment of creditors (Paulian action). Develops and implements for businesses strategies for effective enforcement of their claims and debt recovery.
Successfully represents creditors (including financial institutions) in proceedings for declaration of bankruptcy, insolvency and restructuring proceedings. Represents clients as members of creditors’ committees in insolvency proceedings. Represented clients in disputes with bankruptcy trustees and in negotiating settlements with such trustees, as well as in choosing the most effective restructuring methods for business debtors who are entrepreneurs.
In the years 2021–2024 distinguished as Recommended Lawyer in The Legal 500 EMEA ranking in the Dispute Resolution (Spory) category.
Has cooperated with DJP since its establishmen. In 2017 promoted to partner at DJP.
Graduated in law at the University of Warsaw and completed postgraduate studies at Łazarski University in Warsaw in Restructuring and Bankruptcy Law (restructuring and liquidation of enterprises). Fluent in English.

Insolvency of a Paper Manufacturer
Agata Durczyńska represented one of Poland’s largest banks at all stages of the insolvency proceedings of a company in the paper production and distribution sector, which held dispersed fixed assets across the country. On behalf of DJP, she was responsible for developing and implementing a strategy aimed at re-initiating the debtor’s bankruptcy, in coordination with other key creditors, including managing ongoing enforcement proceedings alongside the bankruptcy filing process. She actively represented the bank as a member of the creditors’ committee, particularly in analyzing, verifying, and providing opinions on documents submitted by the trustee. As a result of the trustee’s actions in cooperation with the creditors’ committee, the bankruptcy estate’s assets were properly secured and restored. Ultimately, the level of creditor satisfaction in the re-opened insolvency proceedings exceeded initial expectations, in many cases resulting in full recovery of claims.
Actions for Fraudulent Conveyance (Paulian Claims)
Agata Durczyńska has extensive experience handling fraudulent conveyance (Paulian) claims, representing corporate clients, including one of Poland’s leading banks. The cases she has managed often involved complex factual circumstances, frequently requiring detailed reconstruction of the debtor’s transactions and identification of assets improperly removed to the detriment of creditors. Drawing on her advanced analytical skills, she has developed effective legal strategies tailored to these intricate and unusual factual situations. The legal arguments she prepared were consistently endorsed by the courts adjudicating the cases. Such disputes are often of critical importance to clients, as a successful Paulian claim frequently represents the only realistic means of recovering the debts owed to them.
CDT Operator Agreement
Agata Durczyńska advised the Polish Development Fund Foundation on the establishment of the Central Technology Hub (CDT)—a unique educational project in Warsaw offering workshop spaces for STEAM-based learning. On behalf of DJP, she managed the CDT project comprehensively at all stages, including drafting and negotiating the operator agreement for the management of CDT and co-developing the full legal documentation related to the project’s implementation. She also participated in multilateral negotiations with project stakeholders and was responsible for organizing and overseeing the transaction’s finalization process.
Disputes Involving Derivatives and Forward Transactions
Agata Durczyńska successfully represented one of Poland’s leading banks in a dispute concerning forward transactions and derivative instruments. Thanks to carefully prepared legal arguments, the case concluded with a favorable outcome in both the first and second instance, and the claim against the client was finally dismissed. The case was exceptionally complex, both factually—covering circumstances from nearly 20 years ago—and legally, due to the numerous allegations raised by the claimant.
