The principal must provide the agent with a statement of commission due, no later than the last day of the month following the quarter in which the agent earned it.<\/p>\n
That is the starting point.<\/p>\n
\u2753 Can the agent verify this settlement?<\/p>\n
Yes, but only within defined limits.<\/p>\n
The agent may:<\/p>\n
1\ufe0f\u20e3 request extracts from the accounting books; or<\/p>\n
2\ufe0f\u20e3 require that a statutory auditor be given access to the books to prepare extracts;<\/p>\n
the auditor should be selected jointly by both parties.<\/p>\n
\u26a0\ufe0f Where does the risk arise?<\/p>\n
In practice, an information claim is rarely an end in itself. It is most often the first step towards recovering commission, and sometimes an attempt to gather material for other claims, such as an indemnity.<\/p>\n
Agents\u2019 requests may consequently go beyond what is genuinely necessary to verify commission.<\/p>\n
