We offer comprehensive legal services to film producers at every stage of the production and exploitation of an audiovisual work – from financing and development, through production and post-production, to distribution and sales in Poland and abroad.
We know the film industry
We understand the realities and needs of producers – we know the specifics of the film financing, relationships with creators, co-producers and distributors. We are familiar with the existing legal risks. Our approach combines in-depth knowledge of the audiovisual market with a practical understanding of the conditions of film production – both from the creative and business sides.
We provide strategic advice
We assist in obtaining financing (Polish Film Institute, co-producers, investors, foreign funds), assess the risks of contracts with the crew and actors, and help secure rights and avoid disputes relating to these issues. We negotiate contracts with creators and their agents. We assist in the creation of companies and other legal vehicles through which film producers make their films.
We provide support during the production process
We assess scripts and define legal risks associated with production. We propose safe, feasible solutions. We provide support on set and help in resolving ongoing issues relating to the project implementation.
We protect the rights and exploitation of works
We secure copyrights, image rights and related rights. We provide support in negotiations with distributors, VOD platforms and broadcasters.
Experience
Film production
Since 2019, we have provided legal support for the production of several feature films and television series, including international co-productions.
Fundraising
We support producers in raising funds for film projects. We have assisted in submitting numerous applications for financial support from public funds, both at the development and film production stages, including under operational programmes and the Polish Film Institute’s incentive programme, as well as from regional funds. We have provided assistance in drafting and negotiating agreements with private entities providing film production financing (co-production agreements, investment agreements, product placement, MG, pre-sales).
Contract drafting and negotiation
We have drafted and participated in the negotiation of agreements necessary for the production of films and series, including agreements concerning project development, contracts with creators (screenwriters, directors, cinematographers, composers), actors, members of production crews and entities involved in the financing, production and exploitation of the work. We have advised on the acquisition of book adaptation rights for the screen and on the transfer of related rights to musical works used in films.
Chain of Title opinions
We have prepared opinions analysing the effective acquisition of rights in the course of film projects, serving to protect the interests of purchasers of rights and licences to exploit films.
Distribution and sale of film projects
We participated in the negotiation of numerous agreements with television broadcasters, VOD platforms and film distributors. We also provided support in contacts with collective management organizations, as well as in disputes concerning rights to audiovisual works and settlements with production partners.
